Tenancy Agreement Templates

A Tenancy Agreement is a legal contract between a Landlord and a Tenant. The agreement can be written or can be verbal. There is no legal requirement to put a Tenancy Agreement in place, but it helps to ensure that both parties understand and acknowledge their respective rights and obligations. In the event of a dispute arising between the Landlord and the Tenant over the tenancy, having a legally valid Tenancy Agreement in place will assist considerably in resolving the matter. Our tenancy agreement is provided in template form and can be easily customised to suit individual requirements. We provide two versions of the assured shorthold tenancy agreement template. The first version of the template includes provision for appointing a guarantor to guarantee the obligations of the tenant. The second version of our tenancy agreement template does not include provision for a guarantor.

The Tenancy Agreement form gives certain rights to both the Landlord and the Tenant. As an example, the Tenant’s right to occupy the property and the Landlord’s right to be paid rent for renting the property. The Tenant has a right to have the property reasonably fit for its purpose. This means that the property must be habitable.

The law does imply certain statutory rights but these are minimal and this is therefore another good reason to use a Tenancy Agreement form to set out the written terms of the Tenancy Agreement.

A point for Landlords to note is that it is not possible to remove the statutory rights that the Tenant has. This means that the Tenancy Agreement cannot contract out of these. Therefore, we deal with the various statutory rights of both Landlords and Tenants on this website.

Our assured shorthold tenancy agreement is available with or without provision for a Guarantor. An assured shorthold tenancy agreement (AST) is the most commonly used of Tenancy Agreements for letting residential properties. The majority of tenancies that have begun after 28th February 1997 are automatically an assured shorthold tenancy.

Tenancy Agreements and Lodger Agreements can operate with a Guarantor as well as the Landlord and Tenant. A Guarantor is a person who agrees to be responsible for the Tenants obligations to the Landlord if the Tenant cannot meet such obligations. For example, if the Tenant could not pay the rent one month, the Guarantor would be responsible for paying that rent.

We have a document of assignment for the transfer of a tenancy agreement. This is so that a Tenant can transfer their Tenancy Agreement to another. The likelihood is that this would be used by the original Tenant to sub-let the property at the discretion of the Landlord.
